Reassessment of titles of Nobility in Malta described in 1878 Report and in recent publications.

 

Maltagenealogy.com is an ongoing research tool. 

 

This page reassesses the incumbents in year 1992, of those titles of nobility published in Charles A. Gauci’s three books dated 1981, 1986 and 1992, namely “The Genealogy and Heraldry of the Noble Families of Malta”, “A Guide to the Maltese Nobility” and “The Genealogy and Heraldry of the Noble Families of Malta (Volume Two)”.

 

The Maltese Nobility was a regulated body during the government of the Order of Saint John (1530-1798).

 

In 1798, all titles of nobility were abolished in Malta by Napoleon’s Government. However, the use of titles of nobility was soon resumed.

 

In 1878, the British-appointed Royal Commissioners expressed the view that its is an unquestionable principle of law that titles of nobility, as they affect social order, must exclusively proceed from the Crown, from which all honours and distinctions must emanate. It cannot therefore be assumed that titles can be lawfully explained, construed or extended by private agreements.

 

In those three books (all published with the full endorsement of a Maltese group known as the “Committee of Privileges of the Maltese Nobility”) Gauci reports a number of private nominations and successions spanning close to 2 centuries, as well as the private revival of titles and setting of new criteria for that group’s recognition of new titles. - All this is contrary to the aforesaid principle.

 

 Maltagenealogy.com has also released much data which was not previously noted either in the 1878 report or any of Gauci’s books.

 

Recent court judgments in Malta also show that a private group may with impunity call someone a baroness one day and not so the next day, even though she may have also been active in the management of that group for a number of years.

 

Maltagenealogy.com’s concern is not that a private group “recognizes” its members as title holders, but whether its own members can prove their own claims to nobility on independent, legal and factual bases backed by cogent and forcible documents issued in an era which is long past. Without such bases the individual claim to nobility becomes totally indefensible, irrespective of whether such claim is upheld or denied by a mere private group.

 

Controversy may arise, but scholarly debate is healthy especially at a time when Maltese law has withdrawn recognition of titles of nobility.
